Cosmetics and Foods

The boundary between therapeutic goods and cosmetics or foods can be blurry.  It might be a word or two, or a minor reformulation that is all that is needed to position your product as a food or a cosmetic rather then a medicine or medical device, or vice versa.

We can assess your products and advise on options that will help you achieve your goals in the a way that suits you best.

Cosmetics (AICIS)

Getting approval for your cosmetics

There is often a fine line between what is a cosmetic product and what is a therapeutic product, and this can come down to the wording of the claims made on the label.  There are also requirements around the ingredients that are allowed to be used in cosmetic products.  Cosmetics are regulated under the Australian Industrial Chemicals Introduction Scheme (AICIS) and their labelling is controlled by the ACCC.

At Archer Emery & Associates, we can help you by:

  • Providing ad hoc advice verbally and/or in writing on regulatory issues related to existing or proposed cosmetics
  • Reviewing ingredients for acceptability for use in a cosmetic
  • Reviewing ingredient status in the Poisons Standard
  • Reviewing labels for compliance with Poisons Standard requirements and for compliance with requirements for labels for cosmetics
  • Ensuring that there are no therapeutic claims inlcuded on labels
  • Proposing changes as needed
  • Advising on requirements for obtaining permission from AICIS (previously NICNAS) if ingredients are not permitted in cosmetics

Foods (FSANZ)

Getting approval on your food products

Foods are regulated by the States and Territories who adopt the Australia New Zealand Foods Standards Code (FSC) which is developed by Food Standards Australia New Zealand (FSANZ).  Foods sold in Australia and New Zealand must comply with the relevant aspects of the FSC.

At Archer Emery & Associates, we can help you by:

  • Providing ad hoc advice verbally and/or in writing on regulatory issues related to existing or proposed foods
  • Reviewing ingredients for compliance with the FSC
  • Reviewing labels for compliance with the FSC
  • Providing advice on issues found and suggesting possible solutions
